CONDITIONS OF SALE: Live Auction Format

The following Conditions of Sale constitute the entire agreement with the National Museum of Wildlife Art and the purchaser and any bidders relative to the live auction items listed in this catalog. The Conditions of Sale and all other contents of this catalog are subject to amendment by us by the posting of such amendments on the Western Visions website (www.wildlifeartevents.org). The property will be offered by us as an agent for the Artist, unless the catalog indicates otherwise.

By participating in any sale, you acknowledge that you are bound by these Conditions of Sale.

  1. SALE – The Western Visions Evening Art Show + Sale (Live Auction) will be held on Thursday, September 14, 2023, beginning at 6:30pm MDT. The estimate range of all artworks is determined by the artist.
  2. AS IS – All artwork is offered “as is” where is, without any representations or warranties by us as to merchantability or fitness for a particular purpose, the correctness of the catalog or other images or descriptions of the physical condition, size, quality, rarity, importance, medium, or frame of the artwork. No statement anywhere, whether oral or written, whether made in the catalog, an advertisement, a bill of sale, or elsewhere, shall be deemed such a warranty, representation or assumption of liability.
  3. BUYER’S PREMIUM
    • A buyer’s premium will be added to the hammer price of each piece of art purchased at auction, and is payable by the purchaser as part of the total purchase price. The buyer’s premium is 20% of the hammer price if paid by cash or check for in-person, proxy, or Bidsquare lot winners.
    • For patrons who win artworks on site at the September 14 event OR for patrons who win artworks by proxy OR on Bidsquare, the buyer’s premium will be 24% if payment is made by credit card.
    • For patrons who win artworks online through LiveAuctioneers, the buyer’s premium will be 20% PLUS any and all processing fees implemented by LiveAuctioneers. Fees vary by form of payment. See platform conditions for specific details.
  4. WITHDRAWAL – The Museum reserves the right to withdraw any lot at any time before the actual sale and shall have no liability whatsoever for such withdrawal.
  5. PER LOT – All bids are per lot as numbered in the print and online catalogs.
  6. RESERVE – All lots are subject to a reserve, which is the confidential minimum price determined by the artist. If the bidding does not reach the reserve price, the lot will remain unsold and the auctioneer will proceed to the next lot. All reserves fall at or below the low estimate. The auctioneer may begin the bidding below the reserve price, and may place bids on behalf of the consignor up to the reserve amount.
  7. BIDDING – The sale format for Lots 1-34 is live auction; with live bidding taking place in the room and online, as well as the execution of absentee bids. The highest bidder acknowledged by the auctioneer will be the buyer, if the reserve price has been met. The auctioneer has the final discretion to determine the successful bidder, cancel the sale, or to re-offer and resell any lot should a dispute arise. The Museum may execute absentee bids on behalf of clients who are not present at the time of sale; however, this service is offered as a convenience and the Museum will not be held responsible for any error or failure to execute bids.
  8. BIDDING INCREMENTS – Bidding increments will be as follows, but may vary at the sole discretion of the auctioneer:

  9. PURCHASER’S RESPONSIBILITY – Winners must complete their purchase within 72 hours of notification. All sales are final with no exchanges or refunds.
  10. SALES TAX – Unless exempted by law, buyers will pay an additional 6% sales tax on the total purchase price for all artworks picked up at the Museum or shipped within the state of Wyoming.
  11. PAYMENT – Cash and check payments are preferred. Visa, MasterCard, Discover and American Express are also accepted. Please note the above-mentioned Buyer’s Premium structure (section 3) will apply to all payments.
  12. EXHIBITION – All artwork will remain on exhibit at the National Museum of Wildlife Art through Sunday, October 1, 2023.
  13. SHIPPING
    • Lot winners must declare whether they will pick up the artwork or elect to have it shipped at the time of the purchase payment transaction.
    • All items must be removed from the Museum between Tuesday, October 3 and Sunday, October 17, 2023 to avoid a $20 per day storage fee thereafter.
    • At the buyer’s request, the Museum may package and ship items as directed by the buyer.
    • The buyer will be responsible for any and all shipping expenses, including packaging materials and shipping fees.
    • All packaging, handling, and shipping is at the sole risk of the buyer, and the Museum shall have no liability for any loss or damage to such items.

CONDITIONS OF SALE: Intent to Purchase Format

The following Conditions of Sale constitute the entire agreement with the National Museum of Wildlife Art and the purchaser and any bidders relative to the intent to purchase items listed in this catalog. The Conditions of Sale and all other contents of this catalog are subject to amendment by us by the posting of such amendments on the Western Visions website (www.wildlifeartevents.org). The property will be offered by us as an agent for the Artist, unless the catalog indicates otherwise.

By participating in any sale, you acknowledge that you are bound by these Conditions of Sale.

  1. SALE – The Western Visions Evening Art Show + Sale will be held on Thursday, September 14, 2023. An in-person, online or proxy event attendance ticket is required to buy intent to purchase artworks. Event ticket sales are non-transferable. The sale price of all artworks is determined by the artist and is a fixed price. Entries for intent to purchase pieces will be accepted from 9:00am MDT on Tuesday, August 1, 2023 through 8:00pm MDT on Thursday, September 14, 2023.
  2. AS IS – All artwork is offered “as is” where is, without any representations or warranties by us as to merchantability or fitness for a particular purpose, the correctness of the catalog or other images or descriptions of the physical condition, size, quality, rarity, importance, medium, or frame of the artwork. No statement anywhere, whether oral or written, whether made in the catalog, an advertisement, a bill of sale, or elsewhere, shall be deemed such a warranty, representation or assumption of liability.
  3. BUYER’S PREMIUMA buyer’s premium will be added to the fixed sale price of each Intent to Purchase artwork purchased and is payable by the purchaser as part of the total purchase price. The buyer’s premium is 17% of the fixed sale price if paid by cash or check and 20% if paid by credit card.
  4. WITHDRAWAL – The Museum reserves the right to withdraw any lot at any time before the actual sale and shall have no liability whatsoever for such withdrawal.
  5. PER LOT – All entries are per lot as numbered in the print and online catalogs.
  6. BIDDING – The sale format is “intent to purchase.” Individuals wishing to purchase a piece must submit their name to a randomized drawing of a winner for each lot between 9:00am MDT on Tuesday, August 1, 2023 and 8:00pm MDT on Thursday, September 14, 2023.
    • **IMPORTANT**: By submitting your name, you are agreeing to purchase the lot at the fixed price if your name is drawn.
    • The drawing for all lots will occur at approximately 8:15pm MDT on Thursday, September 14, 2023. Winners are not required to be present to win. Winners will be announced at approximately 8:15pm MDT on Thursday, September 14, 2023. All winners will receive an additional email or phone notification within 24 hours of the conclusion of the event.
